This agreement is between the Artist and the Commissioner/Purchaser.
AGREEMENT made with respect to the commissioning of an artwork. Once the Commissioner/Purchaser submitted the personal information and the deposit paid, this agreement is bound between the Artist and the Commissioner/Purchaser.
Tasks and activities performed in the creation of the Work:
In the event that The Artist falls ill, or has a disability preventing the progress of the completion of The Work, the project can be extended for a maximum of 2 MONTHS from the date of agreement.
Should there be any delays that are beyond the control of the Artist the project may be extended for a maximum of 6 MONTHS.
Or, the Artist may cancel the project immediately with deposit refunded.
Acceptance:
It is understood that the Artist will use his/her aesthetic skill and judgment to create the Work, and the Commissioner/Purchaser agrees to accept the completed Work unless he/she/it can show that the Work was not executed substantially in accordance with the description agreed.
Payments Schedule:
A non-refundable deposit of 50% is required before the Artist begins work on the commission and is due upon signing this contract. The balance of payment is due upon satisfactory completion and delivery of the artwork described above.
Delivery:
The Artist agrees to complete and deliver the commissioned artwork within 1 Month.
Termination of the Work:
If the Commissioner/Purchaser does not approve of the preliminary design, the Artist shall keep all payments made and the agreement shall terminate.
The Artist may terminate this agreement in the event the Commissioner/Purchaser is more than 60 days late in payment; however, nothing herein shall prevent the Artist bringing suit based on the Commissioner/Purchaserโs breach of contract.
The Commissioner/Purchaser may terminate this agreement if the Artist fails without cause to complete the Work within 30days of the completion date stated herein. In the event of termination, the Artist agrees to return to the Commissioning Agent all payments made to the Artist, but shall not be liable for any additional expenses, damages or claims.
The Commissioner/Purchaser may terminate this agreement in the event the illness of the Artist causes a delay of more than 2 months, or if events beyond the Artistโs control cause a delay of more than 6 months of the completion date provided. The Artist shall retain all payments made pursuant to the above. This agreement shall automatically terminate on the death of the Artist. The Artistโs estate shall retain all payments made pursuant to the above.
Ownership, Copyright and Privacy:
The Artist reserves all rights of reproduction and all copyrights to the Work, the preliminary design, and any incidental work made in the creation of the Work. The Artist shall receive authorship credit in the event of any reproductions of the Work.
The Commissioner/Purchaser gives to the Artist permission to use the Commissioner/Purchaserโs name, picture, portrait, and photograph, including but not limited to exhibition, display, advertising, trade, and editorial uses, without violation of the Commissioner/Purchaser’s right of privacy.
Right of Refusal:
In the event that the Commissioner/Purchaser does not wish to purchase the commissioned artwork, the Commissioner/Purchaser may refuse. In that case, the Artist will retain the refused artwork and the non-refundable deposit. This is free of any claims or interests of the Commissioner/Purchaser and the Commissioner/Purchaser will not owe any additional fees to the Artist.
Returns: There are no returns once the Commissioner/Purchaser takes possession of the artwork.
Alterations, Waivers, Notices, and Change of Address:
Any alterations to this agreement shall be made in writing and e-mail to yayang.nasir@gmail.com.
IN WITNESS WHEREOF the Artist and the Purchaser have executed the Agreement on the day & year once the personal information submitted to the Artist and the deposit paid. No signature is required.

Once the Commissioner/Purchaser submitted the Personal Information, please pay the 50% deposit below according to your commissioning artwork. Once payment received, the Artist will begin the project of commissioning of artwork and the contract bound.
